  1. Off-The-Wall, Inc. Licensing Agreement
  2. PLEASE READ BEFORE INSTALLING SOFTWARE

  4. This is a legal agreement between you (either an individual or an entity) and Off-The-Wall, Inc.  By installing this Software, you
  5. are agreeing to be bound by the terms of this agreement.  You assume full responsibility for the use, installation, and results
  6. obtained from this Software.  Off-The-Wall, Inc. will not accept responsibility for any misuse or any damage caused by misuse
  7. of this Software.  If you do not agree to the terms of this agreement, please return the Software and accompanying items within
  8. seven (7) days to Off-The-Wall, Inc., P.O. Box 112743, Anchorage, AK 99511-2743.  Purchasers of this Software will be given
  9. a full refund.  Users who have received this Software free of charge as an advertisement or promotional package are also bound
  10. by this agreement, but do not have the option of a refund.

  12. 1. GRANT OF LICENSE.  This agreement is a license between you and Off-The-Wall, Inc.  This agreement permits you to use
  13. one copy of the enclosed Software program on a single computer.  The Software is in "use" on a computer when it is loaded into
  14. temporary memory (i.e., RAM) or installed into permanent memory (e.g., hard disk, CD-ROM, or any other storage device) of that
  15. computer.  The Software is not intended to be networked.  For information on network licensing, please contact Off-The-Wall,
  16. Inc.

  18. 2. COPYRIGHT. The Software is owned by Off-The-Wall, Inc. and, in part, by other software manufacturers whose programs
  19. were used to create our customized program.  It is protected by United States copyright laws and international treaty provisions. 
  20. Therefore, you must treat this Software like any other copyrighted material (e.g., book or musical recording) except that you may
  21. either (a) make one copy of the Software and the enclosed Software User Guide, hereinafter referred to as "Documentation,"
  22. solely for backup or archival purposes, or (b) transfer the Software to a single hard disk provided you keep the original solely for
  23. backup or archival purposes.

  25. By stating "like any other copyrighted material," Off-The-Wall, Inc. means that the Software may be used under the license by
  26. any number of people, and may be freely moved from one computer location to another so long as there is no possibility of its
  27. being used at one location while it is simultaneously used at another.  For example, just as a book cannot be read by two
  28. different people in two different places at the same time, neither can the Software be used (without violation of this agreement)
  29. by two different people in two different places at the same time.

  31. OTHER RESTRICTIONS.  You may not rent or lease this Software, but you may transfer the Software and accompanying
  32. Documentation on a permanent basis provided you retain no copies of the Software or Documentation and the recipient agrees
  33. in writing to the terms of this agreement.  You may not reverse engineer, decompile, or disassemble the Software.  If the
  34. Software is an update or has been updated, any transfer must include the most recent update and all prior versions.

  36. This license is not a sale.  Title and copyrights to the Software, accompanying Documentation and any copy made by you remain
  37. with Off-The-Wall, Inc. and other vendors whose products were used to create our Software.  Unauthorized copying of this Software or the
  38. accompanying Documentation, or failure to comply with the above restrictions, will result in automatic termination of this license
  39. and will make available to Off-The-Wall, Inc. and those vendors whose products where used to create this Software other legal
  40. remedies.  Upon termination of this license, or return of the Software pursuant to Off-The-Wall, Inc.'s Return Policy, you must
  41. return all copies of the Software and Documentation to Off-The-Wall, Inc. and erase any copies from your hard disk.
